SUPREME COURT JUDGEMENT ON HIJAB: MURIC ASKS TINUBU TO INTERVENE

5th December, 2022

PRESS RELEASE:

SUPREME COURT JUDGEMENT ON HIJAB:

MURIC ASKS TINUBU TO INTERVENE

An Islamic human rights organisation, the Muslim Rights Concern (MURIC), has appealed to the presidential candidate of the All Progressives Congress (APC) and former governor of Lagos State, Asiwaju Bola Ahmed Tinubu, to intervene in the hijab affair in Lagos State.

It will be recalled that the Supreme Court ruled in favour of use of hijab in all Lagos State schools on 17th July, 2022. MURIC is worried that LASG has not made any statement since the ruling.

This was contained in a statement issued on Monday 5th December, 2022 by the group’s director, Professor Ishaq Akintola.

The full statement reads:

“We are deeply worried that the Lagos State Government (LASG) has not passed any comment on the landmark judgement of the Supreme Court which ruled in favour of hijab on Friday, 17th July, 2022. The ruling sealed a ten-year judicial tussle between the Muslims of Lagos State and LASG.

“Justice Modupe Onyeabor had ruled against the hijab on 17th October, 2014 claiming that it was against the policy of LASG. But in a unanimous decision, the five-man panel of the Appeal Court sitting in Lagos set the high court judgement aside on Thursday, 21st July, 2016. The five-man panel headed by Justice A. B. Gumel held that hijab was a fundamental human right and a religious duty for female Muslims.

“LASG challenged the Appeal Court’s ruling at the Supreme Court and the latter gave its final pronouncement on the matter on Friday, 17th July, 2022, six years after the ruling of the Appeal Court.

“Strangely enough, the government of Lagos State is yet to say a single word since the judgement of the Supreme Court in favour of hijab. Meanwhile repression of female Muslim students continue as school principals and teachers claim ignorance of the Supreme Court judgement. They insist on disallowing hijab until we can produce a circular issued by LASG.

“Islamic organisations and Muslim leaders who were involved in the matter ran into a cul de sac as LASG is not forthcoming on issuing the circular. All efforts made to persuade LASG to release a circular failed.

“On the part of MURIC, we wrote the Commissioner for Education, Mrs. Folasade Adefisayo, seeking audience with her and she met us on Tuesday, 13th September, 2022. MURIC coopted other Islamic organisations like the Muslim Lawyers Association (MULAN), Muslim Students Society of Nigeria (MSSN), Federation of Muslim Women Societies of Nigeria (FOMWAN) and Coalition For Hijab for the meeting.

“Although the Commissioner promised to issue the circular this did not happen to date. As the pressure mounted from the Muslim public who were eager to know why female Muslim children who use hijab to school were still facing persecution, we initiated a text message to the Commissioner as a reminder. This was on Monday, 17th October, 2022, more than one month after she had promised to issue the circular.

“But responding to the text message a week later on 23rd October, 2022, the Commissioner simply said the circular would now be issued by the Head of Service. We began to see delay tactics on the part of LASG as represented by the Commissioner. Or should we be tossed around like ping-pong?

“We are explaining all these so that Nigerians can see how we have waited patiently all this while. We approached the court since 2012 instead of going on protests because protests can be easily hijacked.

“Unlike the #EndSARS children of multiple anger who came with the diabolical motive to destroy Lagos (may Allah never allow that to happen), Islamic organisations in Lagos submitted themselves to the rule of law and refused to tow the path of violent struggle. The court case lasted ten years from 2012 to 2022. Haven’t we been patient enough? Haven’t we been law-abiding?

“LASG appears not to know that its silence over the Supreme Court judgement can be misinterpreted as a deliberate attempt to undermine the rule of law and it may fall foul of contempt of the highest court in the land.

“Perhaps the calculation of the Ministry of Education in particular and LASG in general is that everyone would forget about the hijab issue in the excitement of the ongoing electioneering campaign and so it should be business as usual.

“But those who feel the pain of rejection and the agony of stigmatization have not forgotten. Tears are still rolling down the cheeks of the Muslim girl-child who face daily harassment, intimidation and dehumanization for wearing hijab. Muslim parents at home are devastated by sheer fear of what is going to happen to their hijab-wearing children at school on a daily basis. We will not abandon them.

“It should be noted that MURIC opted to arrange a meeting between the Commissioner for Education in keeping with our avowed motto, ‘Dialogue, No Violence’, but whether or not this move was appreciated by the authorities is another matter entirely. It will not compel us to abandon the noble path of dialogue.

“We still have another option of dialogue. We have resolved to take the case of hijab and the reluctance of LASG to implement the Supreme Court judgement to the architect of Lagos superstructure, Bola Ahmed Tinubu, APC presidential candidate and former governor of Lagos State whose presidential project is our project, to wade into the issue.

“The legal angle of hijab is over. The Supreme Court has blown the final whistle. But LASG has refused to announce the final result of this game. This is the political angle and Asiwaju can resolve this at this material time.

“Justice delayed is justice denied and procrastination is the thief of time. As a major and special stakeholder in the Lagos project, we have decided to take our case to him. What happens when a government refuses to obey a court ruling? Is this the Lagos of his dream?

“We call on Senator Bola Ahmed Tinubu to intervene. MURIC does not issue threats. We have never done it before and we will not do it now. Neither do we issue ultimatum. But whatever LASG does with the hijab case on which the highest court in the land has made a pronouncement will send a strong message to Nigerians particularly at this crucial period.

“If any state government must disobey Supreme Court ruling, it should not be Lagos State, the centre of excellence. LASG has taken the lead in several areas. Other states emulate Lagos. LASG should not reverse this trend particularly as it affects respect for the rule of law, implementation of court decisions and recognition of Allah-given fundamental rights of Lagos Muslims.

“LASG should not put our backs against the wall. Where can a people go after securing a court ruling? This is where we want Tinubu to come in. Lagos is his terra cognito.

“This matter should naturally be of interest to leaders of the ruling party, the APC, in Lagos State. A stitch in time saves nine. This is not the time to allow the opposition to accuse the ruling party of taking actions capable of undermining justice, equity, rule of law and democratic principles.

“The Lagos State House of Assembly should equally be interested in a matter of this magnitude. Lagos Muslims constitute a large chunk of tax payers in the state and the House should show interest in anything that may affect them. MURIC has spoken.”

FIND ATTACKERS OF UGHELLI CENTRAL MOSQUE – MURIC

2nd December, 2022

PRESS RELEASE:

FIND ATTACKERS OF UGHELLI CENTRAL MOSQUE – MURIC

Gunmen attacked a mosque at Ugelli, Delta State, yesterday 2nd December, 2022. They shot eleven Muslim worshippers and kidnapped the Imam. Meanwhile the Muslim Rights Concern (MURIC) has condemned the attack. The group called on security agents to fish out the perpetrators and rescue the abducted Imam.

This was disclosed in a statement issued on Saturday, 3rd December, 2022 by the director of MURIC, Professor Ishaq Akintola.

The statement reads:

“The Imam of Ughelli Central Mosque, Mallam Muhammadu Sani, was yesterday whisked away by gunmen who attacked the mosque. Eleven worshippers were also shot. The gunmen stormed the Mosque located at Otovwievwiere Street in Okorodafe axis of Ughelli by 6 am yesterday, Friday, 2nd December, 2022.

“This is a dastardly act that must be condemned by all right-thinking people and we condemn it in the strongest terms. It is another evidence of hate crimes targeted at Muslims in the South East in recent time. It will be recalled that the Secretary of the Delta State Muslim Council, Mallam Musa Ugasa, a resident of Ughelli, was brutally killed earlier this year by yet to be identified persons.

“Those who claim that only Christians are being killed in Nigeria have many questions to answer. Shaykh Ibrahim Iyiorji was killed in Isu, Onicha Local Government of Ebonyi State on 4th September, 2022. Seven Muslims were killed in Orogie, Owerri, Imo State on 5th August, 2022.

“Another four Muslims were killed in Umuaka, near Orlu on 4th April, 2021. Again, another set of eleven innocent Muslims were mowed down by gunmen in Port Harcourt and Orlu on 20th October, 2020. Five other Muslims were also killed near the popular Abraka market in Asaba, Delta State on 15th September, 2017. The list is endless.

“The latest attack on Ughelli Central Mosque is one too many. MURIC calls on the Commissioner of Police in Delta State Ari Muhammed Ali, to fish out the perpetrators. Muslims have become endangered species not only in Delta State but in the entire South East. The trend must be arrested.”

MURIC TO ADELEKE: YOU ARE NOT FAIR TO CHRISTIANS

1st December, 2022

PRESS RELEASE:

MURIC TO ADELEKE: YOU ARE NOT FAIR TO CHRISTIANS

The last has not been heard of the controversy surrounding the appointment of three Muslims as Chief Press Secretary, Chief of Staff and Secretary to the State Government by Ademola Adeleke, the new governor of the State of Osun. The Muslim Rights Concern (MURIC) has confirmed all three officials are good Muslims. Nonetheless, the group has condemned the appointments on the ground that it has marginalised Christians.

This was the contention of MURIC in a statement issued on Thursday, 1st December, 2022 by its director, Professor Ishaq Akintola.

The full statement reads:

“As a follow-up to our statement of yesterday in which we expressed doubts about the faith of the three Muslims appointed as Chief Press Secretary (CPS), Chief of Staff (COS) and Secretary to the State Government (SSG) by the new governor of Osun State, Ademola Adeleke, we hereby attest that our investigations into the matter have confirmed that all three men are bona fide Muslims.

“The SSG, Rasheed Olawale, is a former chairman of Osogbo Local Government. He sponsored a popular Islamic radio program anchored by Dr. Taofeeq Abdul Hameed and Alhaji Musbaudeen Orimadegun in and out of office for years.

“The COS, Kazeem Akinleye, is also an ex-chairman of Ede North local Government. Muslims who know him very well have confirmed that he is an upright Muslim and an Islamic scholar in his own right. The governor’s spokesperson (CPS), Teslim Igbalaye, is from Iwo. He is even popularly referred to as ‘Malam’.

“MURIC will always admit the truth even if it contradicts its former stand (although we did not say categorically that they were not Muslims). We are not in this struggle for the purpose of scoring cheap political points. On the contrary, it is the truth that we seek to establish.

“It is in this spirit that we object to the appointment of the same three Muslims into the most prestigious offices by Governor Adeleke. Just as we argued yesterday, those three juicy posts should not have been given to Muslims since (and if) the governor himself is a Muslim.

“How can the governor, the SSG, the COS and the CPS be Muslims in a pluralistic setting like Osun? Something does not add up here. Adeleke has played into the hands of those who accuse him of being a secret Christian. They alleged that the nomenclature ‘Nurudeen’ suddenly appeared in the twilight of the 2018 electioneering campaign to curry Muslim votes. He is now trying to appease them. But things do not work like that.

“MURIC is known for criticizing governors who marginalize Muslims in political appointments. We cannot keep quiet now after seeing the way ‘Nurudeen’ has marginalized Christians in his first appointments. We cried to high heaven when Fayose ran an all-Christian government in Ekiti State with the SSG, COS, CPS, all fourteen commissioners, the chairmen of all eight boards and parastatals except the Muslim pilgrimage board being Christians.

“We fight oppression. We will not oppress. We will not support the idea of a Muslim leader oppressing Christians. This ‘Nurudeen’ who has just occupied the government house in Oshogbo is not being fair to Christians if all major appointments made so far are in favour of Muslims. Islam teaches justice, fairness and equity.

“This is what Qur’an 4:135 commands Muslims to do regarding justice and fairness. It says, ‘Stand firmly for justice and be witnesses for Allah, even if it is against yourselves or your parents, or your kin and whether it is against the rich or poor’. In addition, Prophet Muhammad (peace be upon him) forbids cheating and oppression. He said in an hadith, ‘Do not oppress and you will not be oppressed’.

“It is in the light of these Islamic teachings that we disown Adeleke’s first appointments. What Islam teaches is different from what ‘Nurudeen’ has done. We distance Osun Muslims from his action. Islam teaches inclusiveness, ‘Nurudeen’ prefers to exclude Christians in the state. It is not in our character. We believe in loving and sharing.

“We therefore call on the new governor to review the appointments with immediate effect. One or two of the appointees can be moved to the ministries as commissioners. From what we have seen, if we do not act fast, ‘Nurudeen’ may wake up tomorrow and give all cabinet positions to Muslims leaving only the Christian Pilgrims Board for a Christian. Although Muslims are in the majority in Osun, we will not encourage lopsided appointment in a pluralistic society.

“‘Nurudeen’ is setting an awkward precedent unless the appointments are reviewed. It can be used against us in future. Somebody may accuse Muslims of marginalising Christians of the State of Osun. We must also remember that the Christian Association of Nigeria (CAN) is waiting in the wings.

“That brings another angle to what ‘Nurudeen’ has done in the state of Osun. A supposedly Muslim governor appointed three Muslims to the most juicy positions in the state and CAN has not spit fire and brimstone. It is not in CAN’s character. Something is fishy. This may be a setup.

“Why is CAN silent? Why are they not protesting after seeing the way the three biggest slots were given to Muslims just a la carte. MURIC smells a rat. Governor Nurudeen Ademola Adeleke may be acting a script written on the altar. A trap is being set for Osun Muslims.

“Notwithstanding the Jekyll and Hyde scenario, we like to warn the new governor not to cross the red line. Hijab and public schools are our red lines. Any attempt to change the status quo will court the fury of Muslims in the State of Osun. A word is enough for the wise”.
