FUNAAB : REVIEW NIQAB CIRCULAR – MURIC

    

The Senate of the Federal University of Agriculture, Abeokuta  (FUNAAB) yesterday issued a circular in which it approved the use of niqab (veil) for female Muslim students of the institution who wish to use it.

 

 

But an Islamic human rights organization, the Muslim Rights Concern (MURIC) has kicked against a conditionality contained in the circular which requires a veiled female Muslim student to remove the veil during examinations and tests after being checked before entering the examination hall.

 

 

MURIC describes the process as an avoidable duplication. The organization therefore appealed to the university to review that aspect of the circular.

 

The full statement follows:

 

"The Senate of the Federal University of Agriculture, Abeokuta (FUNAAB) yesterday issued a circular in which it partially approved the use of niqab (veil) for female Muslim students of the institution who wish to use it.

 

 

"While we appreciate the University Senate and Management for making this compromise, we wish to place it on record and to request the university to take a second look at the conditionalities particularly item No. 5 of FUNAAB circular Ref FUNAAB/REG/S&A/58/III dated yesterday, 29th September, 2023. The circular was signed by the University Registrar and Secretary to Senate, Bola Adekola.

 

 

“We are deeply disturbed by one of the conditionalities contained in the circular which requires a veiled female Muslim student to remove the veil during examinations and tests after being checked before entering. This is an avoidable duplication. 

 

 

"To be specific, item No. 5 of the circular reads, 'He/she must facially identify him/herself and with his/her identity card and must not use the veil during Continuous Assessment Test (CAT) and Examinations and can sit in the front row of the class.'

 

 

"It is our humble opinion that the university has demonstrated lack of proper knowledge of the situation as regards the life of Muslims. Muslim males do not use veils. Therefore, the use of two pronouns 'He/she' and 'his/her' in item No. 5 is absolutely unnecessary.

 

 

"Secondly, it is not necessary to ask a veiled female candidate who has already been checked, identified and cleared at the entrance of the examination hall or classroom to expose herself throughput the examination or test. This has already defeated the purpose of checking her at the entrance. It amounts to duplication, waste of time and energy, stereotyping as well as subjecting Muslim candidates to intimidation and coercion. 

 

 

"It is certainly hazardous, cumbersome and uncomfortable for someone who is used to covering up to be asked to expose herself in the midst of male candidates and male invigilators. Or does FUNAAB have special examination halls for female candidates to be invigilated by women? 

 

 

"Again, asking female Muslim candidates in niqab to sit in the front row will not help matters. Examination supervisors often come to the front of the hall or classroom. What do we expect the ladies in niqab to do if this happens? Should they drop their writing materials and cover their faces with their hands for as long as the invigilator chooses to remain in front of the classroom? 

 

 

"An examination environment requires full concentration whereas unveiling and double checking will create unease, disquiet and distraction. It will definitely affect the candidates' performance. 

 

 

"The points raised above have proved the illogicality, unsuitability and unworkability of item No. 5. That clause has thrown a spanner in the works.

 

 

“MURIC has immense respect for the University Senate and the academia in general, therefore, while appreciating FUNAAB management once again, we appeal to the Vice Chancellor and Senate of the university to review this particular item with a view to limiting the checking of candidates wearing niqab to once at the entrance of the examination hall or classroom. Such a review will change the status of the approval from a Greek gift."

OBASANJOGATE : LIBERATE TRADITIONAL RULERS FROM THE TYRANNY OF POLITICIANS – MURIC  

    

Amid prolonged controversy over the harassment of Yoruba kings by former President Olusegun Obasanjo, a human rights advocacy group, the Muslim Rights Concern (MURIC), has called on the National Assembly (NASS) and state Houses of Assembly to liberate traditional rulers in the country by repealing laws that give state governors power to depose kings.

 

 

MURIC made the proposal on Friday 29th September, 2023 in a statement circulated by its Executive Director, Professor Ishaq Akintola.

 

The full statement reads:

 

“Ex-President Olusegun Obasanjo recently denigrated Yoruba kings at a state function in Oyo State by commanding them to ‘Stand Up!’ and ‘Sit Down!’

 

 

“It was a most unpolished, extremely demeaning and categorically disparaging behaviour. Obasanjo left his manners in Otta Farm the day he attended that programme. It was a display of tramadolised authoritarianism characteristic of most military rulers past and present all over the world.

 

 

“By commanding Oyo State traditional rulers in that manner, Obasanjo subjected them to public opprobrium and, by inference, he dragged all Yoruba men and women in dirty mud. It was a most audacious, tendentious, and egregious attitude that must be condemned not only by all Nigerians but by every man and woman who originated from the African continent and who is conscious of his Africanness.

 

 

“But above that, Obasanjo’s outrageous behaviour must be seen to have gone beyond Oyo State, beyond Yorubaland and even beyond Nigeria as a country. His provocative treatment of traditional rulers is a heavy slap not only on Nigerian culture but also on the collective identity of black Africa.

 

 

“By logical extension, Obasanjo has shot a poisonous arrow into the heart of the institution of monarchy all over the world. Nigerian traditional rulers are also symbols of kingship everywhere else. From Britain to Canada, from Norway to Spain, from Cambodia to Thailand, from Denmark to the Netherlands and back to Africa from Morocco to Swaziland, Obasanjo has committed infra dignitatem. He has offended the world and degraded humanity.

 

 

“MURIC therefore backs calls for the retired general’s apology. But this provocation must be escalated particularly because Obasanjo himself has remained recalcitrant. He must therefore be made to realise the implications of what he has done. This retired general must apologise to all traditional rulers in Nigeria, in Africa as well as to kings throughout the world. He must apologise to humanity at large.

 

 

“Besides, there must be worldwide condemnation of his unacceptable behaviour towards the crown. Failure to tender unreserved apology to the whole world should attract peaceful protests against his presence at any event anywhere in Nigeria and abroad. No Nigerian who values his tradition must sit with him at any table.

 

 

“Anyone who invites him to his or her event must be prepared to face the embarrassment of guests leaving because of Obasanjo’s presence. Nigerians must not stay in the same hall with this arrogant ex-soldier. Our culture, tradition, norms and values tower above any uniform, be it military or police. African youths must embarrass Obasanjo each time he travels abroad.

 

 

“We call on foreign embassies of countries who cherish kings and honour them to deny Obasanjo entry visa. We also implore such countries to declare him persona non grata. This man must be completely marooned until he apologises profusely.

 

 

“The Muslim Rights Concern is concerned because even the Glorious Qur’an commands obedience to constituted authority. It says, ‘Obey Allay and the Prophet and those in position of authority’ (4:59). Kings are also in position of authority to a large extent. The Shari’ah also recognizes custom except where it conflicts with the oneness of Allah. This is why Muslims also respect traditional rulers.

 

 

“The Glorious Qur’an also gives kings a special status as people enthroned by Allah. It describes Allah as the King of kings who enthrones whoever He wishes as king and removes kingship from whoever He desires (Qur’an 3:26). This presupposes that respect must be given to kings by all and sundry, by presidents and governors, even by serving and retired generals.

 

 

“But there is more to Obasanjogate than mere apology. Nigerians must put on their thinking caps and ruminate on what gave Obasanjo the temerity to assault the traditional instituition. His repugnant action must be traced to the deliberate debilitation of the traditional stool.

 

 

“Don’t blame Obasanjo alone. Nigerians have long thrown the traditional crown to the dogs. We weakened royalty and strengthened democracy. We took the whip from the kings and gave the guns to soldiers and politicians. That was what we did when we enacted laws that empowered governors to depose our traditional rulers. Nobody does that and goes scoot free.

 

 

“Those who forget their sources always regret doing so. Obasanjo must be regretting his action already. That is why he now embarks on a daily tour of palaces to prostrate all over the place. He is like a sick man whom the priest asked to say ‘To’ to get healed. Instead of just saying a single ‘To’, he retorted, ‘How can I say to, to, to, to, to, to, to, for ordinary healing’, Well, he ended up saying seven ‘tos’ but received no healing.

 

 

“Obasanjo was the greatest beneficiary of our general juvenile delinquency which, in forgetfulness of our great past, we tagged democracy. We empowered the politicians and weakened the kings.

 

 

Exempli gratia, Section 38 of the Obas and Chiefs Law of Lagos State empowers the governor to suspend or depose an Oba. The governor must also approve an Oba before he is installed.

 

 

“That is why Makinde is using that power according to his whims and caprices. The name of the Alaafin nominee picked by the Oyomesi has been on his table since November 2022 but he has not announced him because his eyes are on someone else. This is one example of how Nigerian governors abuse their executive power on traditional rulers. They have become the Alpha and Omega.

 

 

“Another example of our draconian laws is Section 6 Cap 26 of the Laws of Northern Nigeria which empowers state governors to depose traditional rulers. The axe has fallen on many traditional rulers as a result of this excessive power given to politicians over the kings.

 

 

“In the South East, Anambra State governor recently deposed three traditional rulers. In the South West, Chief Obafemi Awolowo dethroned the Alaafin of Oyo, Oba Adeyemi Adeniran in 1955, for hobnobbing with an opposition political party. The Olowo of Owo, Sir Olateru Olagbegi, was removed in 1969 by Governor Adeyinka Adebayo.

 

 

“In the North, the former governor of Kano, Abdullahi Umar Ganduje, removed Emir Sanusi Lamido Sanusi ostensibly for breaching Section 13 of the Kano Emirates Council Law 2019. The most irritating, most complicated and most dangerous was the dethronement of Sultan Ibrahim Dasuki on 20th April, 1996 because by so doing, the governor of Sokoto, had removed the leader of all Nigerian Muslims.

 

 

“It is nauseating that even an ordinary local government chairman can give orders to the king in his area. He can also issue query to him. No traditional ruler must travel outside his local government without getting permission from the local government chairman. It is as bad as that.

 

 

“It is not yet Uhuru even if Obasanjo apologises in Oslo (Norway) in the morning, in London in the afternoon and in Morrocco in the evening. We need to go to the root of the matter if we are really interested in protecting the dignity of our traditional rulers. We must not treat the symptom, we must deal with the cause. No experienced firefighter will turn the hose towards the smoke. The real fire must be his target. Obasanjo is mere smoke.

 

 

“At the root of it all and the real fire which must be extinguished is the colonial factor and a political class bent on sustaining the current neo-imperialist mentality. What many did not know was that it was the colonialists who first weakened the powers of traditional rulers by introducing enabling laws for their deposition. Awujale Fidipote fled Ijebu Ode to Epe on self exile in 1883 to avoid dethronement by the colonial governor. Many traditional rulers were dethroned during the colonial period.

 

 

“This proves that dethronement clauses in our laws are inherited from the colonial masters. It is unAfrican. Traditional rulers were not deposed in our culture in the past unless they committed sacriledge. The colonialists embedded those laws in order to diminish our culture. Why must we continue to don the garb of colonial mentality? It is time to emancipate our kings from the hawks and agents of neo-imperialism.

 

 

The solution lies in liberating traditional rulers from the tyranny of politicians by using the same political and democratic process to take the power of dethronement away from governors. This will be the holistic approach to solve the menace and the excesses of state governors.

 

 

“MURIC therefore charges state lawmakers in Nigeria to rise to the occasion. Our Obas, Emirs and Obis are the custodians of our tradition. They are the very quintessence of our customs and our norms. Whoever rubbishes them has diminished our essence. They are the embodiment of our values. You are the only ones who can save them from constant embarrassment from power-drunk political charlatans.

 

 

“Those draconian laws targeted at our traditional rulers must be repealed as quickly as possible. Laws like Section 38 of the Obas and Chiefs Law of Lagos State, Section 6 Cap 26 of the Laws of Northern Nigeria and Section 13 of the Kano Emirates Council Law 2019 must go.

 

 

“The Herods in government houses must be stopped from messing up with our traditional rulers. MURIC is waiting for the first state assembly that will bell the cat. Who will champion the revolution? Who will save our traditional rulers? Where are the ‘Speaking Speakers’?”

The Muslim Rights Concern (MURIC), has felicitated with Engr Ashimiyu Adebowale Oyekan, for emerging as the new president of the Jamaatu Islamiyah worldwide. Engr. Oyekan was elected president of the prestigious organization three weeks ago.

“One of the earliest Islamic organisations in Nigeria, the Jamaatu Islamiyah, has elected a Lagos prince, Ashimiyu Adebowale Oyekan. An engineering icon, Oyekan was elected three weeks ago.



“Engr Ashimiyu Oyekan was a former commissioner of Environment and Physical Planning in Lagos State. An independent civil engineering professional and civil engineering consultant, Oyekan was also a former Operations Manager, GTE International Incorporated, Milan, Italy.



“MURIC congratulates Engr Oyekan on his assumption of the leadership position of the Jamaatu Islamiyah. We also commend the organization for electing the most suitable person as its president. Jamaatu Islamiyah has found another Lawal Augusto.

KADUNA GUN FACTORY DISCOVERY : MURIC HAILS ARMY  

    

Soldiers of Operation Safe Haven discovered a gun factory making different types of guns in Kafanchan,  Kaduna State, on Friday, 22nd September, 2023. Some arrests were made while efforts are still going on to apprehend the remaining suspects.

 

 

Meanwhile the army has been hailed by an Islamic human rights organization, the Muslim Rights Concern (MURIC) whose leader, Professor Ishaq Akintola, described the operation as a major breakthrough and a significant eye-opener in the efforts of security agencies and the Kaduna State Government to unmask those behind the violence in Kaduna State.  

 

The full statement of the MURIC leader which was released in the early hours of Monday, 25th September, 2023, reads :

 

“A gun-making factory was discovered in Kafanchan, Jemaah Local Government Area of Kaduna State on Friday, 22nd September, 2023. Different types of guns ranging from rifles, shot guns, AK 47 rifles, sub-machine guns, pistols and ammunition were found by soldiers of Operation Safe Haven. “We commend the Nigerian Army for this discovery. It marks a major breakthrough and a significant eye-opener in the efforts of security agencies to unmask those behind the violence in Kaduna State.  

 

 

“This discovery is another indubitable proof of the world-class quality of Nigerian soldiers. Our soldiers are gallant professionals. We are proud of them. Given the necessary equipment, motivation and welfare, no army in the world can outclass them.  

 

 

“It is noteworthy that the area where the weapons factory was discovered is in Southern Kaduna (Kafanchan) while the apprehended suspects are Christians of the area who have been at loggerheads with Muslims of Kaduna State for a long time.

 

 

“It is our humble opinion that the pieces will soon begin to fall into place. The Christians of Southern Kaduna have long been playing the victim game. They are always the first to launch attacks and always the first to complain.

 

 

“But Nigerians and the rest of the world believed them because they and their collaborators are the ones who write the stories and they wield immense influence in the press. Now the wind has blown. We have seen the rump of the hen. We can now see that the same Kaduna Christians who claim to be the victims and who make so much noise are the gun manufacturers, sellers and distributors of arms.

 

 

“We charge the security agencies to relentlessly pursue the matter and to leave no stone unturned until all the suspects are rounded up, prosecuted and punished according to the laws of the land. The integrity of the army in particular is at stake here. They must realise that the culprits have a lot of sympathisers in the most unexpected places. The army must not allow any coverup or sabotage.

 

 

“We invite the Kaduna State Government to assign the state ministry of justice to liaise with the soldiers of Operation Safe Haven and the state police command for easy close-marking of the matter until it gets to a logical conclusion. The law must be allowed to take its due course.

 

 

“The public is interested in the outcome of this investigation and the subsequent prosecution. There must be no moonlight tales of dramatic or mysterious escapes. Nigerians will hold the army accountable. Any prolonged interregnum is suspect. Only regular updates will de-escalate this growing tension.”

PROBE FUNAAB RELIGIOUS CRISIS – MURIC

    

As there appears to be no solution in sight for the religious crisis in the Federal University of Agriculture, Abeokuta (FUNAAB), an Islamic human rights organization, the Muslim Rights Concern (MURIC), has called on the Minister of Education, Professor Tahir Mamman, to investigate the circumstances surrounding the religious crisis which has engulfed the institution in order to save it from total collapse.

 

 

In a statement made available to newsmen on Friday, 22nd September, 2023, the Executive Director of MURIC, Professor Ishaq Akintola, accused the vice chancellor of possessing an incurable persecution complex, lack of the spirit of compromise, desertification of crisis management skill and a fixated determination to deny the Muslim girl-child of her right to education.

“The Federal University of Agriculture, Abeokuta (FUNAAB), has been engulfed in religious crisis for several months without any solution in sight. Whereas female Muslim undergraduates who use hijab or niqab in other universities all over the country have free access to their campuses, lecture rooms and examinations, FUNAAB has been a horse of a different colour.

 

 

“Female Muslim students in niqab are disallowed from entering the campus. They cannot attend lectures or write examinations. The situation degenerated about two months ago when a female guest lecturer in niqab who was invited to an Islamic programme in the school was not allowed to enter. It led to a peaceful demonstration held by the Muslim students. There has been no solution weeks after the demonstration and the condition of the female Muslim students remains the same.

 

 

“MURIC is deeply concerned with the plight of the Muslim girl-child in FUNAAB. We cannot fathom the rationale for the harsh treatment being meted out to female Muslim students whose only crime is that they have elected to shun material recklessness, immorality, indecent dressing and prostitution.

 

 

“We are equally at a loss to understand why FUNAAB under the watch of Professor Olusola Babatunde Kehinde should be different among all other Nigerian universities. Female Muslim students who use niqab do so freely in other institutions.

 

 

“Female security personnel on those campuses carry out identification exercises on the veiled students whenever and wherever necessary and there have been no hitches. But the vice chancellor of FUNAAB has totally rejected the idea.

 

 

“It should be noted that many of the female students using niqab in other universities are performing excellently in their studies. One of them just graduated from the University of Lagos with first class (https://twitter.com/muslimnews_NG/status/1702348323523322336?s=19). Another female Muslim, Balquis Bintilaye, who uses the veil was the best graduating student in an American university recently, thereby proving that their brains function normally even with their heads or faces being covered.

 

 

“MURIC invites the Honourable Minister of Education, Professor Tahir Mamman, to save FUNAAB from total collapse by instituting a probe into the circumstances surrounding the religious crisis which began since November 2021.

 

 

“A federal university cannot claim to be unaware of the position of the law on religious freedom in this country. Section 38(i)&(ii) of the 1999 Constitution of the Federal Republic of Nigeria guarantees religious freedom for every Nigerian.

 

 

“As far back as 2009, the Court of Appeal ruled in favour of the use of niqab as a fundamental human right (https://www.intelregion.com/news/from-archive-appeal-court-upholds-students-rights-to-use-niqob-download-full-judgement/; See Provost Kwara State College of Education, Ilorin vs Basirat Saliu Suit No. CA/IL/49/2009, the Court of Appeal, Ilorin Judicial Division).

 

 

“It should be noted that the current vice chancellor, Professor Olusola Kehinde was acting vice chancellor from 1st November, 2022 to 31st March, 2023. He became the substantive vice chancellor on 1st April, 2023. It can therefore be adduced that he is not in any way alien to the role played by the university management in the crisis. Even the fact that the niqab imbroglio continues to fester during his tenure speaks volumes.

 

 

“It is our assumption that the vice chancellor may be nursing an incurable persecution complex, lack of the spirit of compromise, desertification of crisis management skill and a fixated determination to deny the Muslim girl-child of her right to education.

 

 

“Such rigid mien is alien to academic culture. Acute deficiency in leadership qualities and lack of damage control tactics on the part of the vice chancellor may also be at the bottom of his failure to rein in the religious brouhaha on time.

 

 

“We demand a powerful probe panel into the niqab saga. Female Muslim students who have been disallowed from writing examinations should be given the chance to rewrite the papers in the interest of justice and fairness.”
